Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms an integral part of the 99Broker Terms & Conditions, Privacy Policy, Broker Agreement, Buyer Agreement, Seller Agreement, Data Processing Agreement, and all other legal documents governing the use of the 99Broker Platform.
This Policy applies to every User of the Platform including Super Administrators, Administrators, Brokers, Team Members, Agents, Buyers, Sellers, Owners, Builders, Developers, Channel Partners, Organizations, API Users, and Third-Party Integrations.
1. Purpose
The purpose of this Policy is to protect Users and Client Data, maintain Platform integrity, prevent fraud and abuse, promote lawful and ethical conduct, ensure fair use of Platform resources, protect intellectual property, and maintain cybersecurity.
2. Lawful Use
You shall use the Platform only for lawful purposes and comply with all applicable laws, rules, regulations, court orders, and government directions relating to your use of the Platform.
3. Permitted Use
You may use the Platform only for legitimate business activities including property management, buyer/seller/lead management, CRM activities, site visit management, property marketing, brokerage services, document management, communication, analytics, and AI-assisted productivity.
4. Account Responsibility
You are responsible for your account, password, OTP security, device security, user permissions, and all activities performed using your account. Notify the Company immediately if you suspect unauthorized access.
5. Data Accuracy
You shall ensure that information uploaded to the Platform is accurate, current, complete, lawfully obtained, and not misleading.
6. Professional Conduct
Users shall conduct themselves professionally. Harassment, abuse, threats, defamation, discrimination, intimidation, offensive content, and obscene language directed at any User are strictly prohibited.
7. Fraud Prevention
You shall not create fake accounts, submit fake enquiries, upload fake properties, forge documents or identities, misrepresent ownership, manipulate transactions, artificially inflate prices, create fake reviews or leads, or impersonate another User.
Strict Prohibitions: Creating mock leads or generating artificial reviews violates our anti-fraud rules and will result in immediate service suspension.
8. Property Listing Rules
Listings must be genuine, currently available (unless marked otherwise), contain accurate pricing and photographs, include truthful descriptions, and clearly disclose known material facts. Duplicate or misleading listings intended to manipulate search results are prohibited.
9. Client Data Protection
You shall not sell client databases, share client information without lawful authority, download data for unlawful purposes, publish private information, or misuse confidential documents. You remain responsible for complying with applicable privacy laws.
10. Acceptable AI Usage
AI features may not be used to generate false property information, produce fraudulent documents, impersonate persons, mislead Buyers or Sellers, generate spam, commit fraud, or circumvent Platform security. You remain solely responsible for reviewing AI-generated content before publication.
11. Cybersecurity
You shall not attempt unauthorized access, scan vulnerabilities, reverse engineer security mechanisms, bypass permissions, install malicious software, upload viruses, ransomware or spyware, conduct denial-of-service attacks, or use automated tools to compromise Platform security.
Notice: Penetration testing and vulnerability scanning require prior explicit written authorization from our security team.
12. Intellectual Property
You shall not copy Platform software or source code, decompile or reverse engineer proprietary components (except where permitted by law), remove copyright notices, misuse trademarks, or reproduce proprietary content without authorization.
13. API Usage
Where APIs are provided, you shall not exceed rate limits, abuse APIs, circumvent authentication, share API credentials, create excessive automated requests, or interfere with Platform performance.
Note: API access quotas are designed to maintain platform stability and performance. Outages caused by API abuse will trigger automated suspensions.
14. Automation
Users may use automation features only for legitimate business purposes. Automation may not be used to spam users, generate fake enquiries, harvest contact information, circumvent controls, manipulate rankings, or mislead clients.
15. File Uploads
You shall not upload malware, viruses, spyware, ransomware, copyright-infringing material, pornographic, hateful, violent, or illegal content, or forged documents. Uploaded documents remain the responsibility of the uploading User.
16. Communications
Platform communications shall be professional, respectful, lawful, and relevant to legitimate business. Platform messaging may not be used for spam, fraud, harassment, chain messages, pyramid schemes, political campaigning, or unsolicited advertising.
17. Fair Competition
Users shall not steal client data, misappropriate confidential business information, defame competitors, intentionally interfere with another Broker's lawful business, manipulate rankings or reviews, or engage in deceptive practices. Healthy and lawful competition is encouraged.
18. Resource Usage
Users shall not intentionally consume excessive Platform resources through automated attacks, bulk uploads designed to disrupt services, excessive API requests, or resource exhaustion attacks. Reasonable usage limits may be implemented to ensure service quality.
19. Monitoring
To maintain security, reliability, and compliance, the Company may monitor login activity, authentication events, API usage, security events, audit logs, file uploads, and administrative actions, in accordance with applicable law and the Privacy Policy.
20. Enforcement
Where this Policy has been violated, the Company may issue warnings, remove content, restrict features, suspend or permanently terminate accounts, remove listings, preserve evidence, or report unlawful conduct to competent authorities.
21. Reporting Violations
Users are encouraged to report fraud, fake listings, identity theft, security vulnerabilities, forged documents, spam, harassment, or data misuse. Reports made in good faith shall not result in adverse action against the reporting User.
22. Platform Availability
Users shall not intentionally interfere with Platform availability, reliability, or performance. Temporary interruptions may occur due to maintenance, upgrades, or events beyond the Company's reasonable control.
23. Changes to this Policy
The Company may amend this Policy from time to time. Material changes will be communicated through the Platform. Continued use after the revised Policy becomes effective constitutes acceptance.
24. Governing Law
This Policy is governed by the laws of India. Subject to any arbitration agreement and mandatory provisions, disputes shall fall within the jurisdiction of competent courts at Shimla, Himachal Pradesh, India.

USER ACKNOWLEDGEMENT
By creating an account, completing OTP verification, clicking "I Agree", or otherwise using the 99Broker Platform, you acknowledge you have read and understood this Acceptable Use Policy, agree to comply with all its requirements, and understand that violations may result in warnings, suspension, termination of access, or legal action.
