Broker Code of Ethics & Professional Standards

This Broker Code of Ethics and Professional Standards ("Code") forms an integral part of the 99Broker Terms & Conditions and is legally binding upon every Broker, Agent, Team Member, Channel Partner, and any other User conducting real estate business through the Platform.

The purpose of this Code is to promote professionalism, integrity, transparency, fairness, accountability, and lawful conduct within the real estate industry.

Failure to comply with this Code may result in suspension, restriction, or permanent termination of Platform access, in addition to any legal remedies available under applicable law.

01 Purpose

This Code establishes procedures for copyright protection, infringement complaints, notice and takedown requests, counter-notifications, repeat infringement handling, and user and Platform responsibilities.

02 Duty of Honesty

A Broker shall conduct business honestly and shall not knowingly make any false, misleading, deceptive, or exaggerated statement regarding:

  • Ownership of a property.
  • Property dimensions.
  • Property location.
  • Property price.
  • Construction quality.
  • Legal status and RERA approvals.
  • Rental yield/returns.
  • Possession timelines.

Where information has not been independently verified, the Broker shall clearly disclose that fact to the client.

03 Duty of Integrity

A Broker shall:

  • Act honestly in every transaction.
  • Avoid conflicts of interest wherever reasonably possible.
  • Place fairness above personal gain.
  • Maintain professional independence.
  • Refrain from dishonest business practices.

Integrity shall be maintained irrespective of transaction value.

04 Duty of Professional Competence

A Broker shall maintain reasonable professional knowledge regarding: Property transactions, documentation, applicable real estate laws, market practices, regulatory requirements, and Platform usage.

Where specialized legal, engineering, architectural, taxation, or valuation advice is required, the Broker shall recommend that the client seek advice from an appropriately qualified professional.

05 Duty to Clients

Every Broker shall:

  • Treat Buyers and Sellers fairly.
  • Explain material terms honestly.
  • Respond within a reasonable time.
  • Protect confidential information.
  • Avoid unnecessary delays.
  • Avoid creating unrealistic expectations.

A Broker shall not intentionally place personal financial interest above the legitimate interests of the client.

06 Duty of Confidentiality

Except where disclosure is required by law or authorized by the client, a Broker shall not disclose client identity, financial info, contact details, negotiations, offers, or property documents. The obligation of confidentiality continues even after the business relationship ends.

07 Duty of Fair Representation

A Broker shall accurately represent property condition, status, occupancy, pricing, facilities, permissions, and encumbrances. Material information shall never be intentionally concealed.

08 Duty Regarding Property Verification

Before marketing a property, a Broker shall make reasonable efforts to verify owner identity, authority, availability, and basic details. Where verification has not been completed, the Broker shall clearly inform clients that verification is pending.

09 Duty Regarding Documents

A Broker shall not knowingly upload forged documents, alter legal documents, fabricate approvals, use unauthorized documents, or conceal material document deficiencies.

10 Duty Regarding Advertising

All advertisements published through the Platform shall be truthful, accurate, lawful, decent, and non-misleading. Brokers shall not publish false investment appreciation claims.

11 Professional Communication

A Broker shall communicate professionally. Harassment, abuse, threats, defamation, hate speech, discrimination, obscene language, and intimidation are strictly prohibited.

12 Respect for Client Decisions

A Broker shall respect the client's right to accept/reject offers, withdraw, or compare multiple properties. A Broker shall not use coercion or undue influence.

13 Conflict of Interest

A Broker shall promptly disclose any actual or potential conflict of interest, including financial interest, relationship to owner, dual representation, or undisclosed compensation.

14 Commission Transparency

A Broker shall clearly disclose brokerage amounts, commission percentage, payment terms, and applicable taxes. Hidden commissions or secret profits are prohibited.

15 Fair Competition

A Broker shall compete fairly and shall not defame competitors, spread false info, misappropriate competitors' confidential info, or copy proprietary materials without permission.

16 Anti-Fraud Policy

A Broker shall not engage in fake property listings, identity fraud, document fraud, money laundering, fake visits, artificial lead generation, or sham transactions.

17 Responsible Use of Artificial Intelligence

A Broker shall review AI-generated content before publication, correct inaccuracies, and ensure compliance. The Broker remains solely responsible for all published info.

18 Compliance with Applicable Laws

A Broker shall conduct business in compliance with contracts, RERA, consumer protection, privacy (DPDP Act, 2023), anti-discrimination, taxation, and anti-money laundering laws.

19 Reporting Misconduct

A Broker shall promptly report to the Company any known or suspected fraudulent listings, identity theft, forged documents, platform abuse, or serious Code violations.

20 Enforcement

The Company may investigate violations, issue warnings, require corrective action, remove content, restrict features, or suspend/terminate platform access.

21 Continuing Obligation

Compliance is an ongoing obligation. Confidentiality, cooperation, and professional integrity continue after suspension or termination of access.
