Copyright & Infringement Policy

This Copyright & Copyright Infringement Policy ("Policy") forms an integral part of the 99Broker Terms & Conditions, Acceptable Use Policy, Privacy Policy, and all other legal documents governing the use of the 99Broker Platform, a product of 99Yard โ€“ A Unit of Rudra Group.

The purpose of this Policy is to protect the intellectual property rights of creators, copyright owners, licensors, brokers, photographers, architects, developers, and other rights holders whose content may appear on the Platform.

01 Purpose

This Policy establishes procedures for copyright protection, infringement complaints, notice and takedown requests, counter-notifications, repeat infringement handling, and user and Platform responsibilities.

02 Scope

This Policy applies to all content on the Platform including property photos, videos, drone footage, floor plans, architectural drawings, maps, brochures, logos, trademarks, property descriptions, AI-generated content, documents, designs, source code, software, databases, and any other copyright-protected material.

03 Ownership of Intellectual Property

Users retain ownership of content they upload. 99Broker retains ownership of the Platform software, source code, UI, database structure, branding, logos, design, AI workflows, documentation, proprietary algorithms, and platform-generated reports. Nothing in this Policy transfers ownership of intellectual property.

04 User Responsibility

Users represent and warrant that they own the uploaded content or possess all necessary rights, licences, permissions, and authorizations to upload, display, distribute, and use such content. Users shall not upload material that infringes third-party intellectual property rights.

05 Licence Granted to 99Broker

By uploading content, Users grant the Company a limited, non-exclusive, worldwide, royalty-free, revocable licence (to the extent necessary) to host, store, process, display, resize, optimize, cache, distribute, and reproduce content solely for operating, securing, improving, and promoting the Platform. This licence terminates when the content is removed, except where retention is required for backup, legal compliance, fraud prevention, or dispute resolution.

06 Copyright Infringement

Copyright infringement includes uploading copyrighted photographs without permission, copying another Broker's marketing material, uploading copyrighted architectural drawings or floor plans, using copyrighted videos without authorization, copying website content, or reproducing copyrighted documents without permission.

07 Copyright Complaint

A copyright owner or authorized representative who believes copyrighted material has been used without authorization may submit a written Copyright Complaint. The complaint should include: full name and contact information, description of the copyrighted work, identification and location of the allegedly infringing content, statement of ownership or authority, good faith statement, accuracy statement, and electronic or physical signature. Knowingly submitting a false complaint may expose the complainant to legal liability.

08 Review of Complaint

Upon receiving a sufficiently detailed complaint, the Company may review it, request additional information, contact the uploading User, temporarily disable or remove the content, reject the complaint if insufficiently supported, or preserve evidence. The Company is not required to adjudicate ownership disputes and may act reasonably based on available information.

09 Counter-Notification

If a User believes content was removed in error, they may submit a counter-notification containing their name, contact details, identification of removed content, explanation of legal basis for use, accuracy statement, and signature. The Company may forward the counter-notification to the complainant where appropriate.

10 Repeat Infringers

Users who repeatedly upload infringing material may be subject to warnings, content removal, suspension of upload privileges, temporary account suspension, or permanent account termination. The Company may determine repeat infringement based on reasonable evidence and Platform records.

11 Trademark Complaints

This Policy also applies where appropriate to unauthorized use of registered trademarks, trade names, service marks, logos, and brand identifiers. Trademark disputes may require additional documentation demonstrating ownership or authorization.

12 AI-Generated Content

Users remain responsible for ensuring that AI-generated content uploaded through the Platform does not knowingly infringe third-party intellectual property rights. The Company does not guarantee that AI-generated outputs are free from third-party intellectual property claims.

13 Fair Use and Lawful Exceptions

Nothing in this Policy restricts any lawful use permitted under applicable copyright laws, including statutory exceptions and limitations under the Copyright Act, 1957. The Company may consider such lawful exceptions when reviewing complaints but does not provide legal advice regarding their applicability.

14 Preservation of Evidence

The Company may preserve uploaded files, audit logs, upload timestamps, user identification, IP addresses, device information, authentication logs, and electronic acceptance records for investigation, dispute resolution, legal compliance, or law enforcement purposes, subject to applicable law.

15 False Complaints

Knowingly submitting false infringement notices, fraudulent ownership claims, misleading evidence, or malicious complaints may result in rejection of the complaint, suspension of Platform privileges, or legal action where appropriate.

16 Platform Rights

The Company reserves the right, acting reasonably and subject to applicable law, to remove content, disable access, suspend accounts, preserve evidence, cooperate with competent authorities, and refuse restoration of content where infringement appears reasonably established. The Company is not obligated to proactively monitor all uploaded content.

17 Limitation of Liability

99Broker acts as an intermediary technology platform. To the fullest extent permitted by applicable law, the Company shall not be liable for copyright infringement committed by Users. Users remain solely responsible for content they upload, publish, or distribute. Nothing in this clause excludes liability that cannot lawfully be excluded.

18 Governing Law

This Policy is governed by the laws of India, including the Copyright Act, 1957 and the Information Technology Act, 2000. Subject to any arbitration agreement and mandatory provisions, disputes shall fall within the jurisdiction of competent courts at Shimla, Himachal Pradesh, India.

19 Changes to this Policy

The Company may amend this Policy from time to time. Material changes become effective upon publication on the Platform. Continued use after the revised Policy becomes effective constitutes acceptance of the updated Policy.

By creating an account, uploading content, clicking "I Agree", completing OTP verification, or otherwise using the 99Broker Platform, you acknowledge that you have read and understood this Copyright & Copyright Infringement Policy, will upload only content you own or are authorized to use, understand the notice and takedown process, and understand that repeated copyright infringement may result in suspension or permanent termination of your account.
